CarPooling — Captain app
These terms set out your obligations as a captain on the CarPooling platform: eligibility and documents, publishing trips, managing bookings, commission and the wallet, and the rules on cancellation and conduct.
By using the CarPooling captain app or applying to register as a captain, you agree to these terms and to the privacy policy.
If you do not agree with any of them, please do not use the app.
CarPooling is a technology platform that acts as an intermediary between you and customers. The platform is not a transport company and does not own the vehicles.
You are an independent service provider, not an employee of the platform. Using the app creates no employment contract, no obligation to work set hours, and no guarantee of a number of trips or a given income.
You are responsible for the regulatory, tax and insurance obligations related to your activity.
CarPooling is a technology platform that facilitates connections and coordination between users. CarPooling does not itself provide transportation services, employ captains, or own or operate the vehicles used for trips. Each user remains responsible for their own acts, omissions, conduct, and legal obligations while using the platform and during a trip. To the fullest extent permitted by applicable law, CarPooling, its management, administrators, owner or owners shall not be liable for losses or damages arising from an act, omission, error, negligence, misconduct, or legal violation committed by a Customer, Captain, or other third party, and the platform's technical, organizational, or intermediary role does not by itself create an obligation to compensate a user for such conduct. Nothing in this provision excludes or limits any liability or right that cannot lawfully be excluded or waived under applicable law.
You must hold a valid driving licence, and the vehicle must be roadworthy, licensed and insured under local law.
The required documents must be uploaded complete and correct: ID, driving licence, vehicle licence, vehicle photo, and personal photo.
Submitting forged or expired documents, or documents belonging to someone else, leads to the application being rejected or the account being suspended immediately.
The account is activated after the documents are reviewed. The review is not a guarantee of acceptance, and an application may be rejected with no obligation to activate it.
You must update your documents when they expire.
The account is personal and may not be shared or operated by another driver.
Running a trip in any vehicle other than the one registered in your account is prohibited.
You are responsible for keeping your sign-in details confidential and for all activity carried out through your account.
You agree that the trip details are correct: the route, the departure time, the number of available seats, and the stated fare.
You may not publish more seats than the vehicle's permitted legal capacity.
You may not publish fake trips or repeatedly publish trips you do not intend to run.
When you accept a booking, the seat is reserved for the customer and deducted from the trip's capacity.
You agree to update the trip status accurately in the app: on the way, arrived at the pickup point, trip started, and arrived at the destination.
Recording incorrect statuses - such as recording arrival before actually arriving - is a violation that calls for action on the account.
Running a trip depends on sharing your location while the app is in the foreground, so the customer can follow your approach.
Turning location off or tampering with it during a trip in progress may end the trip or restrict the account.
The platform charges a commission on completed trips. The type of commission and its rate or amount are set in the platform settings and shown to you in the app in the trip details and the wallet record.
The commission is deducted from your wallet balance when the trip is completed, and the breakdown of the deduction is shown to you after the trip ends.
When the wallet balance falls below the limit set by the platform, receiving new requests or trips may be blocked until the balance is settled.
The fare is collected from the customer directly, outside the app. The platform does not collect the fare on your behalf.
You can cancel a trip without a penalty before you record arrival at the pickup point.
A cancellation after you record arrival at the pickup point carries a fixed cancellation penalty charged to your wallet.
If the customer cancels after you record arrival and the grace period (5 minutes) has ended, a penalty applies to the customer under the customer app's terms.
Repeated or unjustified cancellations are a violation that affects whether the account can continue.
Agreeing with customers to run a trip outside the app in order to avoid the commission or get around the platform's rules is prohibited.
Asking the customer for an amount different from the fare stated in the app is prohibited.
Using the chat to direct customers to outside channels for business off the platform is prohibited.
Communication takes place through the channels available in the app and only to coordinate the trip.
Using a customer's data or number for any purpose outside the trip, including marketing, personal contact or harassment, is prohibited.
Keeping customers' data or sharing it with any third party is prohibited.
You agree to follow traffic and safety laws, not to drive under the influence of any substance, and to keep the vehicle in good condition and clean.
You agree to treat customers with respect and without discrimination.
Carrying prohibited items or exceeding the vehicle's permitted capacity is prohibited.
Impersonation, using multiple accounts, and manipulating requests, trips or ratings are prohibited.
Harassment, threats, and verbal or physical abuse of any kind are prohibited.
Sending offensive or unlawful content through the chat is prohibited.
Manipulating the platform or trying to get around its security measures is prohibited.
Customers' ratings count towards your displayed average rating.
Pressuring customers for a rating, or trading favours for one, is prohibited.
The platform may remove ratings that break the rules.
Where fraud, incorrect documents, repeated violations or safety reports are detected, the platform may restrict, suspend or close the account.
A restriction may be temporary while verification takes place, and the captain is told the status of their account in the app.
A suspension does not cancel existing financial obligations on the wallet.
You can delete your account at any time from: Settings, then "Delete account".
Deletion cannot be carried out while you have a published trip or a trip or request in progress; it must be cancelled or completed first.
Deletion cannot be carried out before the financial obligations linked to the wallet or commissions are settled.
The account is deactivated immediately and permanently deleted after thirty (30) days, and it can be restored during that period.
If you cannot sign in to the app, you can submit the request from the account deletion request page.
The platform is provided as is and as available, and we do not guarantee that the service will be uninterrupted or that requests will be available at all times.
The platform is not responsible for accidents, traffic offences or damage resulting from your driving or from the condition of your vehicle.
The platform is not responsible for agreements made outside the app.
These terms do not limit any rights that cannot be waived under the applicable law.
To dispute a deduction, a penalty or an action on your account, contact the support team in the app with the trip details.
We aim to handle complaints within a reasonable time and may ask for additional information to verify them.
We may add, change or stop some of the app's features, and the commission or penalty settings may be changed for operational reasons.
When these terms change, the version number and the date of the last update at the bottom of the page change, and continuing to use the app counts as acceptance of the updated version.
These terms are governed by the laws of the country in which the service is provided, and disputes are referred to the competent court there.
